<p>1.       What is a short sale?<br />
A short sale is when a sellers home is being sold for less then what the current mortgage balance is owed. In order for a short sale to be possible it will be subject to third party approval which is the sellers lender. The sellers lender ultimately will have to agree to allow the home to be sold for less than the mortgage balance owed.<br />
2. Will the seller&#8217;s credit rating be affected by a short sale?<br />
While the short answer to this questions is yes, it will be. However there are other so called foreclosure alternatives that may have a greater impact on your credit for<a href="" target=></a> example bankruptcy or just letting the home go to foreclosure.<br />
3. If a seller is in bankruptcy, will that affect the short sale of the property?<br />
Absolutely, most lender would not consider a short sale if the homeowner is in the middle of a bankruptcy proceeding. a short sale between the parties is considered a collection activity and such a negotiation is prohibited in bankruptcy. If you have claimed bankruptcy and want to short sale your home it can be done once the bankruptcy has been discharged.<br />
4. Are there tax implications when short selling a home?<br />
circumstances are individual to the lender. As a short sale represents a loss for the lender, they can report the amount lost a debt forgiveness to the seller. If a formal tax form 1099 is filed, the seller may be responsible for paying taxes on the amount of debt forgiveness.  However every short sale is unique and each lender short sale approval should be read carefully as there have been many times where lenders have given complete debt forgiveness.<br />
5.Why would a lender allow a short sale to occur?<br />
Plain and simple it cost them far less money than having to file a foreclosure proceeding. Remember the banks do not want to own homes.<br />

<p>What happens if I let my house go back to the bank, and the foreclosure sale doesn&#8217;t bring what is owed on the house?  Am I liable for anything else?</p>
<p>I&#8217;m in danger of going into foreclosure due to a high house payment.  I filed Chapter 7 almost 4 years ago and re-affirmed my house. </p>
<p>If a foreclosure sale doesn&#8217;t get what is still owed, will I have to pay anything else??<br />
<br />If you&#8217;re definitely letting your house going back to the bank, do call them up and request for a De<a href="" target=></a>ed-in-Lieu.  All terms on how it&#8217;ll move forward will be in writing; whether you owe the difference or just a small amount or you&#8217;ll waived from all payment.</p>
<p>You may be better off getting a loan modification if you still want to keep the house; or a Short Sale.  Whatever you intent on doing moving fwd, I suggest you at least inquire the info from your lender first.  If you want to read up on your state&#8217;s foreclosure info, go to www.hud.gov or your state&#8217;s website and search for &quot;foreclosure.&quot;</p>

			<content:encoded><![CDATA[<p>First Southern Financial of Decatur, Alabama reported a debt forgiven (repo) from a 1995 account<br />
14 year old account which is not on my credit record as well to the IRS and made it look like a new account for 2006 reporting. I had already filed my taxes for that year. I never recieved a 1099c or 1099a for any notice of a cancellation of debt. I received a notice from IRS I did not report this GAIN and therefore they re figured my taxes and say I owe them about $700.<br />
<br />Don&#8217;t ignore it.  Contact IRS and tell them the story<a href="" target=></a>.  See what they say.</p>
<p>If you were insolvent at the time the debt was forgiven, it won&#8217;t be taxable income.  Of course, that is unlikely.</p>
<p>Did this just come up?  I would have expected you to get a notice over a year ago.</p>
